New Telemarketing Rules in the UAE with Regulation 56 of 2024

The UAE has introduced new measures aimed at regulating telemarketing activities and safeguarding consumers.

Regulation 56 of 2024 outlines that companies engaged in telemarketing must first secure the necessary approval, train their personnel, and keep records of all calls. Telemarketing calls are only allowed between 9 AM and 6 PM. Companies are required to clearly state their identity and the reason for the call. Additionally, they are prohibited from using deceptive methods or aggressive sales techniques. Consumers can opt out by registering on a "Do Not Call" list, and businesses are prohibited from sharing personal information without explicit consent. 

Those failing to comply face penalties that include fines and, in severe cases, suspension or revocation of their licenses.

These new rules impose tighter restrictions on telemarketing practices, ensuring consumers are shielded from unwanted or misleading calls. Businesses are now obligated to follow stringent guidelines, which include securing prior approval, training staff, and retaining records.

Consequences for Non-Compliance: Companies that fail to adhere to the new guidelines will face serious consequences, including hefty fines and potential suspension or loss of their licenses. If a company engages in telemarketing without proper authorization, the penalties can be steep. The initial violation may result in a fine of AED 75,000, which increases to AED 100,000 for a second offense and AED 150,000 for a third.

Additionally, companies are required to thoroughly train their telemarketing staff. Failure to provide adequate training may result in fines starting at AED 10,000, rising to AED 25,000 for repeat offenses, and reaching AED 50,000 for subsequent violations.

When Do These Rules Take Effect? The new telemarketing regulations are set to come into force on August 27, 2024.

In summary, these rules represent a major move toward boosting consumer rights and encouraging fair practices in telemarketing across the UAE.
